SOME EMPLOYERS PLAY WITHIN THE LOOPHOLES OF THE LABOUR LAW BUT THINGS BETTER IN BJP GOVERNANCE THAN BEFORE

WILL MINISTERS MR. UPENDRA YADAV AND MR. RAMESHWAR TELI PROVIDE JUSTICE TO EMPLOYEES IN INDIA?

Though, we have International Labour Organization (UN-ILO), UN- Human Rights, Ministry of Labour and State Labour Departments in India, but still employees are undergoing tremendous pain.

They are running for their own salary that's been withheld by their employers on created grounds that supports employers and corners Employees as the culprit.

At the initial stage, the employee try reaching the authorities, some seek Police help, and some via Labour Department's grievance portal, while others use CPGRAMS portal but all in vain.

Even you know how many of them get justice but things are better than what it used to be before BJP Governance, before 2014. 

THE REAL STORY
Since 2014, when Mr. Narendra Modi took up the office of the Prime Minister, there were a number of changes that took place, Not initially, but later Labour Laws were touched too amending certain norms that were beneficial for the employees. 
But there are always loopholes within the protocols that are played unethically by the employers.

For example : 

Attendance Data
The Biometric scanner attendance data can be manipulated and used as evidence by the employer to untie the compensation order that would otherwise would be binding on them.

Offer Clause
The clauses mentioned in the offer/appointment letter will always have a certain paragraph that reads as "as and when required by the company", or ".....and other work/policies/rules mentioned by the employer". Here, even the claim of the employer upon which he files the case against employer, is included smartly by the employer's legal representative. Hence, if the defendant's lawyer is not strong, employee looses the case.

Time Factor
Grieving employees have family to bread and personal commitments to honour, apart from looking for another employment, and also simultaneously wake the slumbering labour department officers from time-to-time to push their case at the right table. If the employee is fortunate, at the maximum, he/she gets the update from the Labour Department stating the Name of the designated officer who is going to look after his/her case, with officer's email address, landline number and room no.

It may be noted here, that you will never receive any revert if you try emailing the officer, and neither expect that you can talk to the officer by calling on the landline number.
At this point, if the employee gets another job, its very difficult to take leaves and physically meet the officer, and we Indians know that, Government Work is never done in a day.
Hence, in this also, the balls remains in the Employer's court.

RTI
Not all employees opt or know about filing of RTI application. Those who know, they go with it, but still its not as fast as it is assumed to be. There are loopholes here too that the employers are also well-versed with. But this option is better if your grievance goes unanswered on cpgrams or labour department portal.

Leaders Focus
When BJP came in power, the entire Government Department were high on their heels and started clearing-off pending files. Similarly, if the Labour Minister shows interest in reviving the employee grievance redressal mechanism, lives of the grieving Indian Employees will change.

But the question is, "Will Mr. Upendra Yadav Union Cabinet Minister for Environment, Forest & Climate Change; and Labour & Employment, and Mr. Rameshwar Teli - Union Minister of State for Petroleum and Natural Gas, Labour and Employment, GOI show interest in the welfare of employees and award them justice."
The only part that needs to be disciplined in Modi's Governance is, the Employees Grievance Redressal mechanism and providing justice to the grieving employees.
