Pilot Exemption – Families From lifetime Sponsorship Ban Now In Effect



An eligible sponsor includes protected persons, resettled refugees, and dependent child, previously sponsored as spouse, or partner. A 2-year new pilot begins today that shall allow sponsorship applications for a certain group of family members who would be banned from obtaining Canada PR under the Immigration & Refugee Protection Regulations.

The pilot relates to non-accompanying family members who weren’t examined and in some cases not declared when a foreign national applied for Canadian PR, which results in lifetime ban from sponsoring the family members as reads paragraphs 117(9)(d) and 125(1)(d) of the regulations.

These regulations require that foreign nationals applying for Canada PR to declare details about the spouse, dependent children common-law partner, dependent child of a dependent child, and need to have them examined by an immigration staff even if they are not companying the primary aspirant to Canada.

The IRCC says that these regulations are in place to encourage full disclosure by the immigrating aspirant, to enhance the overall integrity of Family Class immigration & to secure, protect the health, safety and security of the Canadians.

Concerns for the disproportionate impact of the lifetime ban on certain individuals like the children, the Canadian Immigration Minister of IRCC Ahmed Hussen announced the 2-year pilot for the eligible family members via a Public Policy earlier during this year.
The pilot will allow immigration to Canada for most vulnerable sects affected by the ban who meet the following norms:

International national in Canada applied as the spouse or as the common-law partner in the Spouse/Common-Law Partner in the Canada Class or as the spouse/common-law partner/ dependent child under the Family Class.

International national has a sponsor who:

Applied for & was been granted PR status as a Convention refugee/person in similar circumstances; or was granted PR after being deemed as a protected person; or was determined to be of the Family Class member & was granted PR as the sponsored spouse/common law partner, conjugal partner/dependent child; or was determined to be the member of the Spouse or Common-Law Partner in the Canadian Class & was granted PR as the sponsored spouse/common-law partner.

International aspirant did not make their sponsor ineligible in the class that the sponsor applied for had they been declared & examined at the time their sponsor immigrated to Canada.

IRCC mentioned that the pilot doesn’t apply if the sponsor was granted PR under the Canadian Economic Class/ any other immigration category isn’t specified in above conditions.

The pilot will remain in effect from 9th September 2019 to 9th September, 2021.

Quebec Skilled Worker Program - Application deadline pulled down

Candidates of the Quebec Skilled Worker Program will have to submit their application for the Quebec Selection Certificate within 60 days post receiving ITA.

Early, deadline was 90 days & the new change was announced on 26 June.

The contraction of timeline is one of the 3 new changes announced by the Quebec Government with regards to the Quebec Skilled Worker Program. The other change is the EOIs (Expressions of Interest) in the QSWP (Quebec Skilled Worker Program‘s) bank of candidates will remain valid for an extra six months.

Further, candidates of EOI who declined the ITA for Quebec Selection Certificate (Certificat de sélection du Quebec, or CSQ) shall be in the bank of applicants for their full validity period.
